In a recent interview with Fox News Digital, John Yoo, who previously served as deputy assistant attorney general in the Office of Legal Counsel during George W. Bush’s first term, expressed concerns about the potential consequences of defying judicial orders. This warning comes in the context of multiple legal challenges facing President Donald Trump’s policies, including his administration’s deportation flights under the Alien Enemies Act.
Yoo highlighted the rarity and severity of a president refusing to comply with a judicial order, referencing Abraham Lincoln’s actions at the onset of the Civil War as the only historical precedent. He stressed the importance of adhering to court orders to maintain the integrity of the legal system, warning that non-compliance could undermine the judiciary’s ability to enforce decisions.
The Trump administration has faced over a dozen injunctions aimed at blocking various policies, ranging from deportation flights to reforms on birthright citizenship. Amid these legal challenges, Republican supporters have criticized what they perceive as ‘activist judges’ improperly infringing on executive powers.
A specific point of contention arose from a case involving U.S. District Judge James Boasberg, who issued an emergency order to halt deportation flights to El Salvador. The Trump administration argued that the planes in question had already taken off before the written order was issued, and thus could not be recalled. They also contested the validity of Boasberg’s verbal order to turn the planes around, which was given shortly before the written order.
Constitutional law professor Josh Blackman described the situation as ‘complex,’ emphasizing the need for judges to respect the co-equal nature of the branches of government.
