Attorney General Bondi Revises Policy on Journalists in Leak Investigations

Attorney General Pam Bondi has announced a significant policy shift, rescinding protections for journalists in leak investigations previously established by her predecessor.

In a move that marks a departure from former Attorney General Merrick Garland’s policies, Attorney General Pam Bondi has decided to revise the Department of Justice’s approach to journalists involved in criminal investigations. The policy change, detailed in a memo obtained by Axios, aims to address what Bondi describes as the misuse of media protections by federal employees leaking sensitive information. ‘This conduct is illegal and wrong, and it must stop,’ Bondi stated in the memo, emphasizing the necessity of the policy change to maintain national security.

The revised policy will allow the Department of Justice to seek records and compel testimony from journalists as a last resort in investigations, reversing Garland’s more restrictive approach. This decision follows recent actions by Director of National Intelligence Tulsi Gabbard, who referred two intelligence community professionals to the Justice Department for criminal prosecution over alleged leaks to major news outlets.

The change has sparked debate over the balance between national security and press freedom. Bruce D. Brown of the Reporters Committee for the Freedom of Press expressed concern over the potential impact on journalists’ ability to protect their sources, although he noted that the full details of the new policy were yet to be seen.

Bondi assured that the use of such investigative techniques would remain limited, with enhanced approval and advance-notice procedures in place. The Office of Legal Policy is currently working on drafting the new language to reflect these changes.
